Manuel Burnley Jr will take his case against the Village of Brown Deer to court next month.
On Thursday, district judge JP Stadtmueller refused the village’s efforts to dismiss Burnley’s case against them.
Burnley was shot in the back by former Brown Deer Police Officer Devon Kraemer in 2016 when she and a partner were attempting to arrest Burnley for disorderly conduct. Kraemer was charged with aggravated battery but a jury couldn’t reach a verdict in her 2018 trial. She eventually retired from the Department in August of 2018.
Burnley, meanwhile, underwent two surgeries and was kept in a hospital for 12 days following the shooting. He says he still suffers permanent damage to his back, lungs, and chest.
