MILWAUKEE — A federal judge is delaying the trial of a Milwaukee County judge to resolve her request for a motion to dismiss.
Judge Hannah Dugan is charged with obstruction for helping an undocumented immigrant evade ICE agents at the Milwaukee County Courthouse in April.
The federal judge first wants to resolve Dugan’s motion to dismiss the charges. In the filing with the Eastern District of Wisconsin, her lawyers claim that the government’s case is “virtually unprecedented and entirely unconstitutional — it violates the Tenth Amendment and fundamental principles of federalism”, specifically claiming that she is “entitled to judicial immunity for her official acts.”
Dugan pled not guilty to the charges, and her trial was originally set for July 21. She is due back in court on July 9 for a status conference.
