MILWAUKEE — Former Milwaukee County Judge Hannah Dugan’s request for a new trial or acquittal has been denied.
Dugan was convicted of felony obstruction in December after she interfered with an immigration arrest in the courthouse last spring.
She was acquitted on a misdemeanor charge related to concealment.
Federal Judge Lynn Adelman, who presided over the trial last year, denied the motion in a 39-page legal briefing Monday.
“After surveying the caselaw, I concluded that there is no general rule of criminal immunity for judges, nor was there a basis for granting immunity simply because some of the allegations in the indictment described conduct that could be considered ‘part of a judge’s job,'” writes Adelman.
Dugan faces a maximum penalty of five years in prison.
She resigned from the bench earlier this year.
