The Milwaukee County District’s Attorney Office will not file charges against Wauwatosa Police Officer Joseph Mensah for the shooting death of Alvin Cole.
“In this case, there is sufficient evidence that Officer Mensah had an actual subjective belief that deadly force was necessary,” says Chisholm in a 14-page report released Wednesday afternoon, “and that belief was objectively reasonable. I do not believe that the State could disprove self-defense or defense of others in this case and therefore could not meet the burden required to charge Officer Mensah.”
Cole was shot by Mensah outside Mayfair mall February 2, 2020 during a police response for a man with a gun at the mall.
WTMJ’s Alex Crowe reports what began as several dozen people has grown to several hundred as the Cole family and attorney Kimberley Motley met with Milwaukee County District Attorney John Chisholm for over an hour Wednesday afternoon.
Mensah was suspended by the Wauwatosa Fire and Police Commission as they continue to investigate his conduct. An independent investigator hired by the commission has recommended Mensah should be fired.
